Biography

Matthew J. Fogelman is a founding partner of Fogelman Law LLC. Mr. Fogelman’s litigation practice is focused on employment law and personal injury cases. He is an experienced trial lawyer, having won a number of significant cases on behalf of plaintiffs, including prevailing before the Massachusetts Supreme Judicial Court in a ground-breaking disability discrimination case involving an employee’s right to use medical marijuana off-site.  Mr. Fogelman also recently prevailed on an age discrimination case in Norfolk County, securing a $1.2 million verdict at trial for his client.

For his work on the Barbuto medical marijuana employment case, Mr. Fogelman was named one of the “Lawyers of the Year” for 2017 by Massachusetts Lawyers Weekly; he also received the award for most outstanding 2017 “Professional Achievement” of any member by USA500, a prominent networking group of lawyers and other professionals, out of 650 members.

For five consecutive years (2018-2022), Mr. Fogelman has been selected as a “Top 100 Super Lawyer” for both Massachusetts and New England, a distinction received by only 100 lawyers out of nearly 44,000 lawyers in Mass. and nearly 80,000 in New England.

In the employment arena, Mr. Fogelman has litigated cases ranging from Wage Act and overtime cases to discrimination, sexual harassment, and retaliation matters. He has significant experience advising employees on non-compete and severance agreements.

In the personal injury realm, Mr. Fogelman has extensive experience litigating complex personal injury cases and emotionally-charged cases, including allegations of sexual abuse and wrongful death, as well as car collisions, slip-and-falls, and dog bites, among many others.

A former newspaper reporter, Mr. Fogelman also has experience in First Amendment and defamation and libel law, and has counseled clients concerning defamatory material published on the Internet.

Mr. Fogelman’s class action practice is focused on helping groups of employees and consumers recover damages in cases in which individually their matters would not be large enough to be cost-efficient. He and the firm have prevailed in several class-action matters, including a significant wage and hour case involving illegal distribution of tips and cases involving tenants who have been the subject of systematic illegal charges of amenity fees and other fees by landlords and large management companies.

About My Practice

Lawyers often talk about standing up for the little guy, and sometimes this sounds cliche.  But in my case, and for our firm, it is true – this is why we practice law.  We relish the underdog mentality. Corporations sometimes act as if there are no consequences for treating workers illegally, including discriminating against employees and systematically depriving them of the wages to which they are due.  They count on employees being afraid to confront wrongful conduct, or that wage underpayment will be not be enough to justify hiring an attorney. Similarly, in injury cases, insurance companies often believe they can use their size and teams of lawyers to avoid paying what their insureds owe for causing crashes, injuries, and even death, and causing catastrophic harm to our clients and their families. We advocate for our clients and fight for their rights, and we will not stop.

We fight for our Community and uphold the Community’s safety. We help balance the playing field.  We hold corporations and defendants fully accountable for wrongful conduct. We demand justice and fair compensation.
